US firearm regulation and liability legal challenges
Overview
Legal challenges and regulatory disputes involving firearm rights and industry liability are unfolding in the United States.
In California, the Second Amendment Foundation (SAF) has challenged the implementation of Senate Bill 704, which requires background checks for firearm barrel transfers. While the bill’s author, State Senator Jesse Arreguín, describes the measure as a “common sense” effort to prevent the assembly of untraceable weapons, the SAF argues the law is unconstitutional and warns that its implementation could lead to mass false rejections due to system errors.
Simultaneously, the SAF and the National Rifle Association (NRA) have petitioned the U.S. Supreme Court to intervene in a case regarding firearms advertising liability. The groups filed an amicus brief in Daniel Defense v. Lowy, seeking to overturn a Fourth Circuit decision that allowed a lawsuit to proceed against firearm manufacturers. The plaintiffs allege that marketing using military and law-enforcement themes promoted a “warrior mentality” that influenced a shooter. The SAF contends that holding manufacturers liable for the criminal actions of third parties based on marketing imagery would create “unprecedented legal liability for the industry.”
