U.S. immigration enforcement and deportation legalities

Recent legal developments highlight significant financial and judicial scrutiny regarding U.S. immigration enforcement and deportation procedures.

In one instance, the Department of Homeland Security (DHS) issued a fine of $1,829,352 to Hector Alessandro Negrete, a Mexican national, due to a 2009 deportation order he failed to comply with for over 15 years. Under current law, individuals failing to depart following a final removal order can be fined $998 per day. Reports suggest that since the start of the second Trump administration, over 100,000 undocumented migrants have received similar fines, reportedly generating more than $84 billion in revenue.

Separately, a federal judge in Maryland ordered the U.S. government to pay at least $164,527.70 in legal fees following a lawsuit involving the deportation of Venezuelan asylum seeker Daniel Lozano Camargo. The judge ruled that the government’s actions, which involved deporting Lozano Camargo to El Salvador’s Terrorism Confinement Center under the Enemy Alien Act, lacked a “reasonable basis in both law and fact.” The ruling determined the government’s position was not substantially justified.
