US passport application policy changes
Overview
The U.S. Department of State has released draft guidance to implement President Donald Trump’s August 6 executive order (EO 14418), which seeks to restrict birthright citizenship by targeting “birth tourism.”
The proposed regulations would require parents or legal guardians applying for children’s passports to provide evidence of their own U.S. citizenship or immigration status. Specifically, U.S. citizens may be asked for a passport or birth certificate, while non-citizens may need to present I-94 forms or Green Cards. The State Department intends to use this documentation to enforce restrictions outlined in the order, which denies citizenship to children if a parent works for a foreign government in the U.S., engages in fraud to obtain citizenship, or is classified as an “alien enemy.”
This initiative follows a previous attempt to limit birthright citizenship, which the Supreme Court struck down in a 6-3 decision for violating the 14th Amendment. Legal challenges continue; a federal judge in Maryland, Deborah Boardman, recently issued an injunction blocking the order’s application for children included in a class-action lawsuit, describing the measure as “almost certainly unconstitutional.”
