Concurrently, New York Attorney General Letitia James and Governor Kathy Hochul filed a lawsuit on July 31 in Manhattan Supreme Court accusing Kalshi of operating an illegal, unlicensed gambling business. The complaint alleges that users as young as 18 can wager on sports, elections and other events without a New York gaming license or required taxes, and seeks forfeiture of illegal gains, restitution for consumers and civil penalties up to three times the company’s profits—estimated at up to $36 billion.
Kalshi maintains its contracts are CFTC‑regulated derivatives; a CFTC emergency motion to block the suit was denied by a federal judge.
