In a 150-page ruling, Pitman determined that extreme heat in uncooled facilities violates the Eighth Amendment’s prohibition against “cruel and unusual punishments.” The judge noted that current mitigation efforts, such as fans and cooling towels, are insufficient, citing testimony of inmates suffering from illness and fainting. The ruling cited evidence of at least nine deaths linked to extreme heat in Texas prisons between 2023 and 2025. The TDCJ, which estimated systemwide installation costs at approximately $1.5 billion, has stated it intends to appeal the decision.

Similarly, the Arizona Department of Corrections, Rehabilitation and Reentry has requested over $130 million to complete HVAC installation projects. This follows previous budget cuts that left more than 6,500 beds without completed cooling systems, occurring alongside investigations into prison deaths and record-breaking regional temperatures.
