Overview
The U.S. Supreme Court has agreed to review a lawsuit involving the admissions policies of four magnet middle schools in Montgomery County, Maryland. The case, Association for Education Fairness v. Montgomery County Board of Education, was brought by a coalition of parents who allege that the district’s lottery-based selection process discriminates against Asian American students to increase enrollment for Black and Latino students.
The current system, implemented during the COVID-19 pandemic, qualifies students for a lottery based on standardized test performance relative to their elementary school peers. Plaintiffs argue this disadvantages Asian American students who are often concentrated in high-performing, low-poverty schools. While a lower court previously dismissed the lawsuit, finding no evidence of discriminatory intent, the Supreme Court will now address whether a plaintiff challenging a neutral policy must establish that a targeted racial group suffered an aggregate disparate impact.
The ruling is expected by the end of June 2027.
