US VA disability compensation and administration
Overview
Veterans in the United States have various legal avenues to challenge Department of Veterans Affairs (VA) disability rating decisions, including Higher-Level Reviews and Supplemental Claims. These processes allow veterans to address incorrect ratings or present new evidence to ensure financial accuracy.
Following discussions on compensation and cost-of-living adjustments, a report from the VA Office of Inspector General (OIG) revealed approximately $5.6 million in disability overpayments. The investigation, which reviewed decisions made between June 2024 and May 2025, found errors in at least 17,900 cases, or roughly 38% of those reviewed.
The OIG attributed these errors to a Disability Benefits Questionnaire that fails to distinguish between objective and subjective evidence, leading to evaluations without sufficient support. The report also identified instances of “pyramiding,” where physical manifestations of a disability were evaluated under two separate diagnostic codes, contributing to the overpayments.
