Vietnam labor law amendments for overseas workers

During discussions regarding amendments to the Law on Vietnamese Workers Working Abroad under Contract, Vietnamese lawmakers proposed strict measures to address contract violations and illegal residency. Proposals included implementing temporary or permanent exit bans for workers who violate contracts or reside illegally in host countries, as such actions have reportedly led some international markets to suspend labor recruitment from certain localities.

Legislators also addressed the high financial burden on poor workers, suggesting service fee caps and the creation of a national database to improve oversight.

Following these discussions, the National Assembly passed amendments to the law, which are scheduled to take effect on March 1, 2027. The new regulations focus on protecting migrant workers from financial risks and debt. Key provisions include restricting service enterprises from collecting training and skill development fees until a worker has been selected by a foreign employer and signed a contract. Furthermore, the law establishes a maximum 180-day waiting period for departure after selection; if a company fails to facilitate departure within this window, they must compensate the worker for damages and refund service fees. The law also mandates that service enterprises notify local People's Committees at least three days before starting recruitment activities to increase transparency.
