Overview
In early July 2026 Vietnam introduced Decree 253, exempting personal income tax on the sale of an individual’s sole residential house or land parcel when held at least 183 days and meeting ownership conditions, with exclusions for new homes, partial sales, and additional properties, while family transfers remained tax‑free.
By late July the Ministry of Agriculture and Environment released draft amendments aimed at curbing speculative activity. The proposals would levy high taxes on abandoned or idle land and on short‑term “flip” transactions, adjust land‑premium differentials, and anticipate changes to the Tax Management Law, Housing Law and Real Estate Business Law, positioning tax tools as a central mechanism for stabilising the market.
On 24 July the Ministry of Agriculture and Rural Development sought feedback on a further amendment to the Land Law. The draft expands eligibility for the red title (land‑use certificate) to owners of parcels that violated procedural rules before 1 August 2024, provided the land is used stably, is dispute‑free, complies with zoning, does not affect national security or the environment, and all financial obligations are settled. It retains exclusions for leased land outside approved infrastructure projects, reclaimed land, and encumbered parcels, and removes the requirement that land‑transaction contracts be notarised. The draft also introduces a 2‑3 million VND fine for owners who fail to register a change of ownership within 30 days and proposes a unified land‑price database linked to tax, notary and banking systems. The amendment is slated for submission to the National Assembly in early August.
