Vodafone legal and regulatory disputes in Germany

Vodafone is facing multiple legal challenges in Germany regarding its business practices and contract management.

In a market abuse dispute, the Higher Regional Court in Düsseldorf rejected Vodafone’s attempt to declare the Federal Cartel Office biased. This allows the agency to proceed with proceedings concerning allegations that Vodafone used its influence over infrastructure provider Vantage Towers to obstruct competitor 1&1 from expanding its mobile network.

Separately, the Court of Justice of the European Union (ECJ) has ruled against Vodafone’s ability to unilaterally change contract terms. The court clarified that EU directives do not grant providers an automatic right to such changes, noting that regulations primarily establish a consumer's right to extraordinary termination rather than granting providers broad discretion to alter terms at will.

This ruling significantly impacts a large-scale class action lawsuit initiated by the Federation of German Consumer Organisations (vzbv). More than 116,000 individuals are seeking refunds and interest following price increases applied to fixed-line internet contracts starting in early 2023. The lawsuit alleges that Vodafone used unfair terms to raise monthly fees by approximately five euros without adequate justification. While the ECJ decision provides a legal signal, the specific outcomes of ongoing proceedings at the Higher Regional Courts of Hamm and Düsseldorf remain to be determined as German courts incorporate the ECJ's interpretation into their rulings.
