5th U.S. Circuit Court hears arguments over mifepristone access
The 5th U.S. Circuit Court of Appeals in New Orleans is hearing arguments regarding the regulation of mifepristone, a drug used in the majority of abortions in the United States. The legal challenge, brought by Louisiana Attorney General Liz Murrill, seeks to restrict the ability of providers in states where abortion is legal to mail medication to patients in states with bans or tighter restrictions.
Proponents of the lawsuit argue that current federal regulations allow for a workaround to state laws. Conversely, advocates for abortion access contend that the medication is safe and effective, and that restricting telehealth and mail-order access would disproportionately impact patients. The case also involves questions regarding the FDA's authority and whether it adequately studied the safety of loosening prescribing requirements.
While the Supreme Court previously issued an order in May to maintain current telehealth access during ongoing litigation, the outcome of this appeals court hearing is expected to eventually return to the high court for a final determination.
