In late August, U.S. Chief District Judge Reed O’Connor paused a federal lawsuit filed by the attorneys general of Florida and Texas that sought to revoke the Food and Drug Administration’s (FDA) approval of the drug. On September 9, the 5th U.S. Circuit Court of Appeals in New Orleans heard arguments concerning the regulation of the drug. The challenge, brought by Louisiana Attorney General Liz Murrill, focuses on whether current federal regulations allow a “workaround” to state laws by enabling telehealth and mail-order access.

Advocates for access argue that restricting these methods would disproportionately impact patients, while proponents of the lawsuit question the FDA’s authority and the adequacy of its safety studies regarding loosened prescribing requirements. Although the Supreme Court previously ordered that current telehealth access be maintained during litigation, the outcome of these appeals is expected to return to the high court for a final determination.
