Brazil tax reform introduces dual IVA and updated Simples Nacional rules

Brazil's tax reform is entering a practical implementation phase, introducing a dual Value Added Tax (IVA) composed of the federal Contribution on Goods and Services (CBS) and the state/municipal Goods and Services Tax (IBS). The transition is scheduled to begin in 2027 with the CBS, followed by a gradual implementation of the IBS between 2029 and 2032.

For companies in the Simples Nacional regime, new rules from the CGSN allow for a hybrid model where businesses can remain in the simplified regime while opting to pay IBS and CBS through the regular regime. Additionally, the deadline for the mandatory use of the National NFS-e Issuer for Simples Nacional taxpayers has been postponed from September 1 to November 1, 2026, to allow for technological adaptation.

To prevent immediate disruption, the Federal Revenue Service and the CGIBS announced that electronic tax documents will not be rejected if they lack the new IBS and CBS fields. This flexibility aims to provide a buffer for businesses as they update their systems. The reform also includes a Selective Tax targeting products harmful to health or the environment and is expected to impact various sectors, including fintechs, pharmacies, and condominiums, requiring significant strategic and financial planning.
