AI chatbot conversations used as legal evidence

Conversations with AI chatbots like ChatGPT and Claude are increasingly being used as evidence in legal proceedings, as they lack the legal privacy protections afforded to communications with lawyers, doctors, or therapists.

Recent cases highlight this vulnerability. In one instance, a teenager's private chats with ChatGPT regarding family matters were obtained by opposing counsel during a lawsuit against social media companies. In another criminal case in Florida, OpenAI alerted the FBI after a user described plans to harm an ex-girlfriend; the resulting investigation led to an arrest.

Courts have established that AI interactions do not constitute protected professional communication. A federal judge in New York recently denied a request to protect a financial executive's conversations with Anthropic's Claude, ruling that the chatbot is not an attorney. As users increasingly turn to AI for personal, medical, and financial advice, the lack of legal privilege poses significant privacy risks.
