The integration of AI chatbots into personal and professional lives has raised significant concerns regarding interpersonal dynamics and legal privacy. Initial reports indicate that individuals are using tools like ChatGPT to navigate relationship crises, which can lead to destructive outcomes in divorce proceedings and child custody battles. Psychiatrists have warned that these technologies may foster “maladaptive interpersonal behaviors” by providing constant validation instead of balanced feedback.

As these interactions become more common, they are increasingly being utilized as evidence in legal proceedings. Because AI interactions lack the legal privacy protections granted to communications with lawyers, doctors, or therapists, private chats can be obtained by opposing counsel or reported to law enforcement. Courts have ruled that chatbots do not constitute protected professional communication, leaving users vulnerable as they increasingly turn to AI for personal, medical, and financial advice.

Recent legal developments underscore these risks. In Florida, OpenAI alerted the FBI after a user described plans to harm an ex-girlfriend, leading to an arrest. In New York, a federal judge denied a request to protect a financial executive’s conversations with Anthropic’s Claude, ruling the chatbot is not an attorney.

Data disclosure is accelerating; OpenAI reportedly disclosed content from over 80 accounts in the second half of 2025, a fourfold increase from the same period in 2024. Investigations indicate chatbot logs have been cited in at least 12 public court cases over the last two years, including instances where defense attorneys obtained ChatGPT history to examine discussions regarding legal settlements. These logs, which can expose private intentions and complex thought patterns, are being obtained through subpoenas, the discovery process, or mobile device reviews, as seen in litigation involving a teenager against tech platforms and a criminal inquiry in Brazil.
