Andalusia implements new university law amid legal disputes

The new Andalusian University Law, known as LUPA, is being implemented for the current academic year despite ongoing legal and political disputes between the regional government and the central Spanish government. Approved by the Andalusian Parliament in February to align with the Organic Law of the University System (LOSU), the regulation has faced significant opposition.

Critics, including public university rectors, labor unions, and student groups, have raised concerns regarding its legality. The central government previously identified approximately thirty articles that it considers incompatible with the Spanish Constitution. While both parties have entered a negotiation process to resolve these discrepancies, the law remains in a state of tension.

The core of the controversy involves jurisdictional boundaries. While the state establishes common frameworks through LOSU, autonomous communities manage planning and financing. Conflict arises when regional laws attempt to regulate matters that the LOSU reserves for individual university autonomy, potentially exceeding the regional government's legal competencies.
