Aneel postpones decision on Enel São Paulo contract termination

The National Electric Energy Agency (Aneel) has postponed a decision regarding the potential termination of Enel São Paulo's energy distribution contract. During a recent board meeting, director Gentil Nogueira requested a review period to further analyze the case, interrupting the voting process.

Relator Agnes da Costa and director Ludimila Lima had already voted in favor of recommending the contract's caducity (termination). Costa argued that the recommendation follows repeated, uncorrected structural failures and massive power outages that affected millions of consumers in the São Paulo metropolitan area between 2023 and 2025. She emphasized that regulatory penalties had proven insufficient to force necessary improvements.

Enel has contested the proceedings, attributing the widespread outages to extreme weather events and public infrastructure issues, such as inadequate tree pruning. The company has also raised concerns regarding its right to defense and has signaled potential legal action.

If Aneel approves the recommendation, the final decision will be passed to the Ministry of Mines and Energy. The current contract is set to expire in 2028, but a termination would represent an unprecedented move in the Brazilian energy sector. Estimates suggest the costs associated with such a termination could exceed R$ 10 billion.
