Enel energy concession dispute in São Paulo
Overview
The regulatory process regarding the potential termination of Enel’s electricity distribution concession in São Paulo has faced delays and calls for further study. Following service failures linked to extreme weather events between 2023 and 2025, the Federal Court of Accounts (TCU) recommended that the Ministry of Mines and Energy and the National Electric Energy Agency (Aneel) conduct a structured study on alternatives to contract termination. This study must evaluate the net benefit to consumers, potential new operators, transition timelines, and impacts on electricity tariffs.
Within Aneel, the decision-making process has stalled. During a recent board meeting, director Gentil Nogueira requested a review period to further analyze the case, interrupting the voting process. This follows votes from relator Agnes da Costa and director Ludimila Lima in favor of recommending the contract’s caducity (termination). Costa argued that the recommendation is a response to repeated, uncorrected structural failures and massive power outages that affected millions of consumers in the São Paulo metropolitan area, noting that regulatory penalties have proven insufficient to force improvements.
Enel continues to contest the proceedings, attributing widespread outages to extreme weather events and public infrastructure issues, such as inadequate tree pruning. The company has also raised concerns regarding its right to defense and has signaled potential legal action. If Aneel approves the recommendation, the final decision rests with the Ministry of Mines and Energy. While the current contract is set to expire in 2028, a termination would be an unprecedented move in the Brazilian energy sector, with potential costs estimated at over R$ 10 billion.
