Discord appeals ANPD suspension of live streaming in Brazil
Discord has filed an administrative appeal against the Brazilian National Data Protection Authority (ANPD) to overturn the suspension of its live streaming and video sharing features. The platform's 'Go Live' function and screen-sharing capabilities have been inactive since August 17 following a regulatory decision aimed at enhancing protections for children and adolescents.
The ANPD's decision follows an investigation into the platform's failure to prevent risks to minors, specifically regarding a case where a 13-year-old girl was allegedly driven to suicide by a coordinated hate campaign. Discord has contested the measure, arguing it is disproportionate and that the ANPD lacks the legal authority to suspend services under the Digital Statute of Children and Adolescents, suggesting such actions require judicial intervention.
As an alternative to the suspension, Discord has proposed a Compliance Plan or a Conduct Adjustment Agreement (TAC) to establish clear technical milestones for the gradual restoration of services. Meanwhile, the ANPD has expanded its oversight, initiating monitoring of 22 major digital platforms, including social networks and AI tools, to ensure compliance with digital safety and child protection regulations in Brazil.
