Anthropic wins court ruling against Pentagon blacklist
A U.S. federal judge has blocked the Pentagon's attempt to blacklist the AI company Anthropic, ruling that the designation was an illegal act of retaliation. U.S. District Judge Rita Lin found that Defense Secretary Pete Hegseth's decision to label the Claude creator a national security supply-chain risk was “illegal and baseless” and violated the company's First Amendment rights.
The dispute arose after Anthropic refused to remove safety guardrails from its AI models to allow for use in U.S. surveillance or autonomous lethal weaponry. In response, the Pentagon designated the company as a supply-chain risk—a label typically reserved for foreign adversaries—which effectively barred Anthropic from certain military contracts.
In her ruling, Judge Lin stated that “the empty invocation of national security is not a blank check to punish and retaliate against government critics.” Anthropic also alleged that the move violated its Fifth Amendment right to due process by denying the company a chance to dispute the designation. Industry groups, including the Computer & Communications Industry Association, supported Anthropic, warning that using procurement tools for political retaliation undermines U.S. innovation and competitiveness.
