Anthropic legal and regulatory tensions with US government
Overview
The AI company Anthropic has entered a period of heightened tension with the United States government. To manage expanding international relations and domestic government interactions, Anthropic appointed Mariano-Florentino Cuéllar, a former California Supreme Court justice, as its first chief global affairs officer. This leadership change follows a legal dispute regarding a Pentagon designation that labeled Anthropic a supply-chain risk.
In a 59-page decision, U.S. District Judge Rita Lin ruled that the Department of Defense acted illegally, finding the designation was unlawful retaliation for the company’s refusal to allow its Claude AI models to be used for mass surveillance or fully autonomous lethal weaponry. The court determined the government’s actions were arbitrary and capricious, violating Anthropic’s First Amendment rights to free speech and Fifth Amendment rights to due process. Judge Lin noted that national security does not provide a “blank check” to punish critics of the administration. The ruling effectively overturns the blacklisting that had prevented military contractors from doing business with the company.
Following the legal victory, the regulatory conflict appears to be subsiding. U.S. Commerce Secretary Howard Lutnick stated that the firm is “back on the right side” of the government, signaling a de-escalation of tensions. This follows earlier friction in June when the Commerce Department imposed temporary export restrictions on Anthropic’s Fable 5 and Mythos 5 models, which were subsequently lifted. As Anthropic moves toward a potential initial public offering (IPO), the resolution of these disputes is viewed as a critical step in stabilizing its standing, particularly as its revenue run rate reportedly reached $65 billion in August.
