Honduras enacts energy reform to restructure ENEE

Honduran President Nasry Asfura has sanctioned the Ley de Justicia Energética, a major legislative reform aimed at restructuring the national electricity sector. The law mandates the reorganization of the Empresa Nacional de Energía Eléctrica (ENEE) into a parent company with three state-owned subsidiaries responsible for generation, transmission, and distribution. This structural change is intended to improve operational efficiency, reduce technical and non-technical losses, and attract international investment without privatizing state assets.

A key provision of the new law is a temporary freeze on electricity tariffs for six months, effective once the decree is published in the Official Gazette. This freeze prevents the ENEE from passing on cost increases to consumers during this period, with the government set to absorb the financial difference through subsidies. The Congress holds the authority to extend this freeze for an additional six months.

The reform also includes debt amnesty provisions for residential users with average monthly consumption of up to 250 kWh and for certain municipalities. Additionally, the law strengthens the technical and financial autonomy of the Comisión Reguladora de Energía Eléctrica (CREE) and establishes the Operador del Sistema y Mercado (OSM) to manage energy dispatch at minimum cost.
