Argentina proposes regulation of extrajudicial debt collection
A legislative proposal has been introduced in Argentina to regulate extrajudicial debt collection practices. The initiative aims to prevent harassment and abusive tactics used by collection agents against debtors.
The project seeks to establish clear guidelines for debt management, including imposing sanctions on both collection agents and creditors when necessary. Key provisions include prohibiting intimidation, deception, or pressure exerted on debtors or their social circles, such as family, neighbors, or employers. It also proposes limits on contact frequency, restrictions on communication during inappropriate hours, and requirements for collectors to clearly identify themselves, the creditor, the origin of the debt, and available payment methods.
The proposal comes amid rising debt levels in the country. According to data from the Centro de Economía Política Argentina (CEPA) as of July 2026, approximately 5,935,719 people in Argentina are in a state of delinquency, with over 154,000 cases reported in the province of Entre Ríos.
