Argentina implements new Juvenile Criminal Regime lowering age of responsibility
Argentina is preparing for the implementation of Law 27.801, a new Juvenile Criminal Regime set to take full effect on September 5, 2026. The law significantly alters the judicial treatment of adolescents by lowering the age of criminal responsibility from 16 to 14 years. Under this new framework, adolescents aged 14 to 17 can be held criminally liable for any offense listed in the Penal Code, a departure from the previous system that only applied to crimes with sentences exceeding two years.
Key provisions of the reform include a maximum sentence of 15 years for adolescents and a strict prohibition on life imprisonment or perpetual reclusion. Additionally, the law establishes that parents or tutors will be held civilly liable for damages caused by the minors. The regime emphasizes restorative justice, education, and social reintegration, offering alternatives to incarceration such as community service, educational programs, and house arrest.
Various provinces are currently coordinating their local legal frameworks to align with the national mandate. Córdoba has already approved provincial reforms to ensure total alignment, while San Juan is conducting inter-institutional meetings to prepare its judicial and security forces. In Tucumán, authorities are focusing on inter-institutional coordination to address the transition. However, the reform faces criticism from juvenile criminal defense attorneys, who argue the law is unconstitutional and violates international human rights treaties regarding the principle of non-regressivity of rights.
