Argentina Supreme Court intervenes in transport subsidy dispute

The Supreme Court of Argentina has declared itself competent to oversee a legal dispute between the province of Buenos Aires and the national government. The conflict centers on the elimination of the Compensation Fund for Urban and Suburban Passenger Public Transport in the Interior (FCI), which was intended to offset financial imbalances in transport services outside the AMBA area.

The province of Buenos Aires, led by Governor Axel Kicillof, is challenging the constitutionality of the fund's cessation, which was formalized through DNU 280/2024. The provincial administration argues that the removal of these subsidies has caused significant budget instability and led to increased bus fares for users in the interior. The province is seeking a precautionary measure to compel the national government to transfer owed funds, including interest.

The Court has granted the administration of President Javier Milei 60 days to respond to the lawsuit. Once the response is submitted or the deadline expires, the tribunal will decide whether to issue an injunction for the immediate transfer of funds. The Court also declared competence in similar claims brought by the provinces of La Rioja and La Pampa.
