Argentine Supreme Court legal rulings
Overview
The Supreme Court of Justice of the Nation has issued rulings on distinct legal matters involving customs and provincial funding.
In a customs valuation case involving Wabro S.A., the Court upheld a decision to revoke a tax charge by the General Directorate of Customs. The dispute addressed whether royalties paid to brand owners should be added to the customs value of imports. The Court found that the royalty payments did not meet the specific requirements under the GATT 1994 agreement to be considered a condition of sale.
Separately, the Court has declared itself competent to review a lawsuit filed by the Province of Buenos Aires against the National Government regarding the elimination of the Compensation Fund for Urban and Suburban Public Passenger Transport in the Interior of the Country (FCI). Established by Law 27.467, the fund was intended to offset financial imbalances for transport services outside the AMBA region.
The provincial administration, led by Governor Axel Kicillof, argues that the removal of these funds via Decree 280/2024 is unconstitutional, causing budgetary instability and increased ticket prices. The province is seeking the recovery of unpaid funds from 2024, plus interest, and has requested an injunction to prevent the Executive Branch from issuing further regulations that contradict existing laws. The Court has granted the administration of President Javier Milei 60 days to respond to these claims, which also include similar legal actions from the provinces of La Rioja and La Pampa. The justices, including Horacio Rosatti, Carlos Rosenkrantz, and Ricardo Lorenzetti, will rule on the injunction request once the response is received or the deadline expires.
