A U.S. federal court in Washington, D.C., has authorized the Titan Consortium to begin the process of seeking and requesting the seizure of Argentine assets located in the United States. The ruling, issued by Judge Jia M. Cobb on September 25, aims to satisfy a judgment of approximately US$390.9 million plus interest.

The debt stems from the 2008 expropriation of the Argentine airlines Aerolíneas Argentinas and Austral. The decision follows a favorable ruling from the International Centre for Settlement of Investment Disputes (ICSID), a World Bank tribunal. Judge Cobb noted that in the 21 months since the payment order, Argentina has apparently made no effort to comply with the judgment.

While the ruling allows the Titan Consortium to initiate legal requests for asset seizures, it does not constitute an immediate seizure of specific assets. The fund must now identify suitable assets and present formal requests to the appropriate courts, which may include jurisdictions in New York and Washington. Legal experts have noted that the creditors may target commercial assets, such as aircraft, though such actions are subject to strict U.S. laws regarding sovereign immunity.
