Argentina court orders reinstatement of Cristina Kirchner's widow pension

A judicial injunction ordered the National Social Security Administration (ANSES) to resume the widow’s pension that former President Cristina Fernández de Kirchner receives as the surviving spouse of the late President Néstor Kirchner. The benefit amounts to about 15.7 million pesos (roughly $12,000) gross per month and will be paid starting in August 2026. The order applies only to the pension derived from Néstor Kirchner’s death; the separate lifetime presidential pension remains suspended.

ANSES will make the statutory deductions for health insurance and income tax and will also apply a 20 % discount – roughly 3.14 million pesos per month – to recover funds it says were over‑paid, with a total recovery target of about 660 million pesos. The additional “zona austral” supplement will not be paid because the former president is serving house arrest in Buenos Aires.

The government plans to appeal the decision, arguing that the conviction in the 2024 Vialidad corruption case – which resulted in a six‑year prison sentence and a permanent ban from public office – should preclude any special pension benefits. The reinstatement is provisional pending a final ruling by the Supreme Court, and the case could set a precedent for how criminal convictions affect pensions for former officials.
