Arizona court blocks union initiative to dismantle ESA program

A lower court ruling has determined that a union-backed initiative to dismantle Arizona’s Empowerment Scholarship Account (ESA) program failed to gather enough valid signatures to qualify for the November ballot. Following a challenge by the Goldwater Institute in the case of Clark v. Fontes, county recorders reported that only approximately 245,000 of the 421,451 submitted signatures were valid, falling roughly 10,000 short of the 255,949 required by law.

The American Federation for Children, which invested significant funds into the legal challenge, stated that the shortfall was due to critical errors made by the unions during the signature collection process. While the ruling prevents the initiative from appearing on the upcoming ballot, advocates for school choice noted that appeals are expected to reach the Arizona Supreme Court on an expedited timeline. Supporters of the ESA program are now calling for legislative action to ensure the long-term sustainability of the scholarship program.
