In late July 2026, Arizona’s contentious school‑choice ballot initiative, the Protect Education Act, faced multiple legal challenges over the validity of its petition signatures. On July 23, the Goldwater Institute and the Arizona Free Enterprise Club sued, alleging that more than 73,000 of the 420,000+ signatures were collected by paid circulators, some with felony convictions, and contained false or incomplete information. The suit coincided with a state‑house resolution framed as a benefit for military families, which opponents viewed as an attempt to undermine the measure.

Three days later, the Arizona Education Association and the Save Our Schools coalition, which submitted the petition, disclosed that over 80% of the signatures were gathered by paid workers, many bearing serious criminal records—including sexual abuse, kidnapping, human trafficking and murder. Funding for the drive came largely from the National Education Association. The Goldwater Institute’s challenge highlighted additional defects such as duplicate and non‑voter signatures, threatening the initiative’s ability to meet the required threshold.
