Flávio Dino nullifies amendments directed by party leaders FAST-MOVING

Supreme Court Justice Flávio Dino has declared parliamentary amendments null if their allocation was influenced by party presidents or former lawmakers without current mandates. The decision aims to enforce transparency and prevent individuals without constitutional authority from directing public funds. Dino ruled that any document, such as spreadsheets or official requests, attempting to attribute authorship or decision-making power to these non-legislators is legally invalid.

The ruling follows investigations into the potential involvement of PL President Valdemar Costa Neto and former deputy Eduardo Cunha in directing amendments. Both individuals had their assets frozen in July. While 19 political parties informed the Court that their presidents do not hold formal quotas or power to allocate these resources, the Podemos and Solidariedade parties failed to respond to previous inquiries. Consequently, Dino has imposed a daily fine of R$ 100,000 on both parties if they do not provide clarification within five business days.

Additionally, the Justice ordered the Chamber of Deputies and the Senate to immediately notify technical bodies and staff regarding the invalidity of such indications. The statements provided by the responding parties will be forwarded to the Federal Police to assist in ongoing investigations into the internal organization and execution of parliamentary amendments.
