Australia to crack down on migration lawyers exploiting visa loopholes

The Australian government is launching a crackdown on migration lawyers and agents who exploit loopholes by lodging visa or asylum applications they know are unlikely to succeed. Assistant Citizenship Minister Julian Hill stated that the government intends to implement new professional standards to prohibit agents from assisting with applications that lack a factual or legal basis.

This initiative is part of a broader migration reform aimed at reducing net migration and curbing system abuse. Current regulations allow registered agents to proceed with futile applications if a client provides written acknowledgment of the risk. Under the proposed changes, such practices will be banned. Hill criticized certain professionals for selling ‘false hope’ and using deceptive online advertising to instruct clients on how to fabricate asylum claims.

Data indicates that approximately 90 percent of protection visa applications are refused at the initial stage. The government is also investigating unregistered operators who charge vulnerable groups for illegal immigration advice. These reforms coincide with other measures, including new restrictions for international students and increased detention center capacity to manage overstayers.
