Austria faces judicial crisis amid prison overcrowding

Austria's Justice Minister Anna Sporrer has warned that the country may be unable to guarantee humane prison conditions within six to nine months if inmate numbers continue to rise. As of October 1, there were 9,204 inmates in a system with a capacity for 8,421. Sporrer noted that overcrowding and staff shortages are already hindering rehabilitation efforts, such as the closure of prison workshops.

Beyond prison overcrowding, the Austrian judicial system is facing a severe personnel crisis. Professional associations for judges and prosecutors have announced an 'action week' of protests from October 12 to 16 to highlight critical shortages. Estimates indicate a nationwide deficit of 250 judges and 70 prosecutors. Legal professionals report that current workloads are at approximately 120 percent capacity, forcing many to work excessive hours to manage the caseload.

In response, the Ministry is considering several measures to alleviate pressure, including expanding electronic house arrest, facilitating conditional releases, and introducing a package to promote community service in place of short prison sentences. Additional civil law reforms are also planned to accelerate legal proceedings.
