Austrian prison overcrowding and staffing crisis
Overview
Austria is experiencing a crisis within its correctional facilities, characterized by rising inmate populations and deteriorating safety and mental health conditions. Ombudsman Gaby Schwarz reported that suicide rates in prisons between January and August 2026 matched the total recorded for the entire previous year, with 8 suicides and 33 attempts documented. These issues are compounded by staff shortages, inadequate psychiatric care, and increased violence.
As of October 1, 2026, there were 9,204 inmates in facilities designed for 8,421 people. Justice Minister Anna Sporrer has warned that the system may be unable to “guarantee humane conditions within six to nine months” if inmate numbers continue to rise. Overcrowding and staff shortages are already hindering rehabilitation efforts, including the closure of prison workshops. To alleviate pressure, the Ministry is expanding electronic house arrest, working on conditional releases, facilitating early releases to inmates' home countries, and introducing community service as an alternative to short prison sentences. Additional civil law reforms are also being planned to accelerate legal proceedings.
The situation has drawn political scrutiny, with the FPÖ party issuing an urgent inquiry in the Bundesrat and accusing the Minister of negligence regarding structural deficits, staff shortages, and excessive overtime.
Adding to the systemic strain, the judiciary is facing a severe personnel crisis. Judicial professional associations have announced an ‘action week’ from October 12 to 16, during which courts will limit operations to essential and legally mandated proceedings. Reports indicate a nationwide shortage of approximately 250 judges and 70 prosecutors, resulting in workloads estimated at 120 percent of standard capacity. Some judges have described the current workload as effectively working a ‘six-day week’ to manage the growing backlog.
