Germany: Seasonal gardening restrictions end October 1

In Germany, the legal protection period for nesting birds and insects ends on October 1, allowing for more intensive gardening activities. Under the Federal Nature Conservation Act, radical pruning, the removal of hedges, and the cutting back of shrubs were prohibited between March 1 and September 30 to protect wildlife.

Starting October 1, property owners may perform stronger pruning and rejuvenation of woody plants. However, experts and organizations like NABU warn that this is not a “free pass” for indiscriminate cutting. Gardeners must still check for active nests, holes, or hibernating animals such as hedgehogs and squirrels, as general species protection laws remain in effect year-round.

Specific guidance for autumn gardening includes:

- Pruning certain species like apple and pear trees is recommended, while stone fruits like cherries or peaches should generally be avoided in autumn.

- Property owners must maintain public safety by ensuring branches do not obstruct sidewalks (minimum 2.50 meters clearance) or roadways (minimum 4.50 meters clearance).

- Respecting neighborly rights is essential; branches overhanging property lines should not be cut without prior consultation with the neighbor.
