BC Prosecution Service declines appeal in Vanessa Terry murder acquittal

The BC Prosecution Service has announced that it will not appeal the acquittal of Frederick Charlie, who was accused of the second-degree murder of 33-year-old Vanessa Terry.

Terry was found dead on the Seabird Island First Nation reserve near Agassiz, B.C., on April 6, 2024. The case was investigated as an instance of alleged intimate partner violence. Charlie was acquitted after prosecutors called no evidence, following a judicial ruling that tossed out his alleged confession. Justice Palbinder Shergill had previously criticized the tactics used by the Integrated Homicide Investigation Team, describing the treatment of the accused by investigators as “degrading and humiliating.”

The prosecution service stated that the appeal process under the Criminal Code is “onerous” and that they determined an appeal was not viable after a careful review. Terina Roberts, the sister of the deceased, expressed profound grief and a loss of trust in the justice system following the decision.
