Belgium municipalities implement right of first refusal for housing

The municipality and the social housing company Dijledal have implemented a right of first refusal in several village centers, including Oud-Heverlee, Sint Joris Weert, Blanden, and Haasrode. This policy, effective as of August 1, 2026, aims to strengthen local housing policy and increase the availability of affordable homes.

Under this regulation, if a homeowner in a designated zone intends to sell their property or building land to a third party, the municipality or Dijledal has the option to purchase it at the same price and under the same conditions agreed upon between the seller and the original candidate buyer. The notary is required to inquire whether the right of first refusal will be exercised before the deed is finalized.

Several exceptions apply to this right. It does not apply to individuals purchasing their first and only home, apartments with shared ownership, or individual building plots within a larger subdivision. Additionally, the right does not cover gifts, inheritances, or sales to children or grandchildren. The policy is intended to allow the local government to intervene in the market to secure housing without affecting the seller's ability to set their own price.
