Bertioga Riviera de São Lourenço settlement ratified by Federal Court
The Brazilian Federal Court has ratified a settlement to resolve a decade-long civil public action concerning the Riviera de São Lourenço development in Bertioga, São Paulo. The agreement, which has been in litigation since 2016, establishes approximately R$ 40 million in environmental and infrastructure commitments.
Crucially, the settlement requires no use of public funds. Key provisions include the purchase of 48 hectares in Guaratuba for environmental preservation, valued at R$ 26 million, and an R$ 8 million engineering project to regularize the Bertioga Canal. Additionally, R$ 6 million will be allocated to construct a new administrative facility for the Brazilian Navy at the Port of Santos.
The agreement was reached through mediation involving the Federal Public Ministry, the Union, the State of São Paulo, the municipality of Bertioga, and the companies responsible for the development. Any future construction of a marina in the Riviera de São Lourenço remains strictly contingent upon obtaining all necessary environmental licenses and regulatory authorizations.
