Bombay High Court orders CBI probe into Disha Salian death case
The Bombay High Court has ordered the Central Bureau of Investigation (CBI) to take over the investigation into the 2020 death of celebrity manager Disha Salian. A division bench comprising Justices Sarang Kotwal and Ranjitsinha Raja Bhonsale issued the order following a petition by Salian’s father, Satish Salian, who alleged that the Mumbai Police investigation was inadequate and failed to register a First Information Report (FIR) despite allegations of gang-rape and murder.
The court noted “glaring discrepancies” in the initial police probe, which had only registered an Accidental Death Report (ADR) and concluded the death was a suicide. The bench criticized the police for allowing the investigation to drag on for six years without filing an FIR for a cognizable offense. The CBI has been directed to register a new FIR under the Bharatiya Nyaya Sanhita (BNS), record Satish Salian’s statement, and appoint a senior, experienced officer to lead the probe.
The court also ordered the Malvani Police Station to hand over all relevant records and documents to the CBI. While the investigation will examine all aspects of the death, the court clarified that no individual should be treated as an accused unless sufficient evidence is gathered during the probe. If the CBI finds no cognizable offense, it must file an appropriate summary or closure report, which the petitioner retains the right to challenge.
