The Bombay High Court has ordered the Central Bureau of Investigation (CBI) to conduct a fresh probe into the 2020 death of celebrity manager Disha Salian. This follows a petition by her father, Satish Salian, who alleged that the Mumbai Police failed to properly investigate claims of murder and gang rape, opting instead to register only an Accidental Death Report (ADR).

In its ruling, a division bench of Justices Sarang Kotwal and Ranjitsinha Raja Bhonsale criticized the police for failing to register a First Information Report (FIR) for six years despite the gravity of the allegations. The court noted “glaring discrepancies” in the initial probe and stated that the investigation raised more questions than it answered. Concerns have also been raised regarding the management of the original scene and the potential for evidence tampering.

The court directed the registration of a new FIR under the provisions of the Bharatiya Nyaya Sanhita (BNS). It ordered the Malvani Police Station to immediately hand over all relevant case records to the CBI and directed that a senior, experienced officer be appointed to lead the investigation. The court also mandated that the CBI record the statement of Satish Salian.

The ruling has triggered political friction in Maharashtra. BJP leader Ram Kadam questioned why the previous Uddhav Thackeray-led government did not grant a CBI probe at the time, alleging attempts to shield prominent figures. Aaditya Thackeray, a leader of the Shiv Sena (UBT), dismissed these claims as a smear campaign.

The court emphasized that no individual should be treated as an accused unless the investigation uncovers sufficient material to support such a charge. If the CBI finds no evidence of a cognizable offence, it must file a summary report, which Satish Salian retains the right to challenge through a protest petition.
