Bosnia and Herzegovina adopts ‘Do Not Call’ electronic register

The Council of the Communications Regulatory Agency (RAK) of Bosnia and Herzegovina has adopted the Rule on the public electronic register ‘Do Not Call’. This initiative establishes a unified regulatory and technical mechanism to protect users of fixed and mobile telephone services from unwanted direct marketing communications.

Previously, Bosnia and Herzegovina lacked a centralized electronic register that allowed operators and marketing entities to verify a number's status before sending promotional calls, SMS, or MMS messages. The absence of a unified registration and deregistration process created legal uncertainty for users, operators, and advertisers alike.

The new rule has received a positive opinion regarding its compliance with European Union legal heritage, specifically Directive 2002/58/EC concerning data processing and privacy in the electronic communications sector. An information solution for the register has already been developed. The register is expected to be established within 120 days following the adoption of specific administrative and technical instructions.
