Bosnia and Herzegovina settles investment dispute with Slovenian company EGS
Bosnia and Herzegovina has concluded an investment arbitration case with the Slovenian company Elektrogospodarstvo Slovenije - razvoj in inženiring (EGS) through a settlement. According to the Attorney General's Office of Bosnia and Herzegovina, the settlement resulted in no reduction of the state's assets, ensuring its interests were fully protected.
The proceedings were conducted before the International Centre for Settlement of Investment Disputes (ICSID) in Washington, based on the investment protection agreement between Slovenia and Bosnia and Herzegovina. The dispute originated from EGS's involvement in financing the construction of the Ugljevik Mine and Power Plant during the former Yugoslavia, which included electricity supply agreements that were interrupted in 1991 due to conflict in Croatia.
EGS had initiated two separate legal actions in 2014: a commercial arbitration against the Ugljevik Power Plant in Belgrade and this investment arbitration against Bosnia and Herzegovina. The commercial case was resolved in 2023 through agreements between the power plant and EGS. The parallel investment arbitration was finalized by a settlement order from the arbitral council on August 3, 2026.
