Bosnia and Herzegovina-Slovenia investment arbitration

Bosnia and Herzegovina has settled an investment arbitration case with the Slovenian company Elektrogospodarstvo Slovenije – razvoj in inženiring (EGS). The proceedings were conducted through the International Centre for Settlement of Investment Disputes (ICSID) in Washington, following an investment protection agreement between Slovenia and Bosnia and Herzegovina.

The dispute stemmed from EGS’s role in financing the construction of the Ugljevik Mine and Power Plant during the former Yugoslavia. Electricity supplies from the plant were interrupted in 1991 due to conflicts in Croatia. In 2014, EGS initiated two legal actions: a commercial arbitration against the Ugljevik plant in Belgrade, which was resolved in 2023, and this investment arbitration against Bosnia and Herzegovina.

The investment arbitration was finalized via a settlement order from the arbitral council on August 3, 2026. The Attorney General's Office of Bosnia and Herzegovina stated that the settlement resulted in “no reduction of state assets” and asserted that the country’s interests were fully protected.
