Bosnia and Herzegovina settles Slovenian investment arbitration

An investment arbitration case brought by the Slovenian company ‘Elektrogospodarstvo Slovenije – razvoj in inženiring’ (EGS) against Bosnia and Herzegovina has concluded with a settlement. The proceedings were held before the International Centre for Settlement of Investment Disputes (ICSID) in Washington, based on an investment protection agreement between Slovenia and Bosnia and Herzegovina.

EGS had previously participated in financing the construction of the Ugljevik Mine and Power Plant during the former Yugoslavia, receiving electricity from the plant until supplies were interrupted in 1991 due to conflicts in Croatia. In 2014, the Slovenian company initiated two legal actions: a commercial arbitration against the Ugljevik plant in Belgrade and an investment arbitration against Bosnia and Herzegovina via ICSID.

The Attorney General's Office of Bosnia and Herzegovina stated that the settlement, finalized following a Council of Ministers conclusion, resulted in no reduction of state assets, asserting that the country's interests were fully protected.
