Brazil advances legal reforms for concessions and PPPs

Brazil is advancing legislative and institutional efforts to reform the legal framework for concessions and Public-Private Partnerships (PPPs). Marcus Cavalcanti, Special Secretary for the Investment Partnership Program (PPI), stated that Bill 2373/2025, which aims to reform the legal framework for concessions and PPPs, is expected to move forward in the Senate during the current legislature. Senator Davi Alcolumbre has reportedly committed to scheduling the matter for debate.

The proposed bill seeks to revise the Concessions Law and the PPP Law, expanding financing mechanisms and contractual rebalancing to increase legal certainty for infrastructure projects. A key feature of the proposal is the division of risks between the State and private companies, intended to attract more private investment into public services and infrastructure.

In a related development, representatives from the National Confederation of Insurers (CNseg) participated in the National Forum of PPPs and Concessions 2026 in Brasília. The forum, organized by the Special Secretariat for the Investment Partnership Program (SEPPI) in partnership with Banco do Brasil and Caixa Econômica Federal, focused on the role of insurance and guarantees in managing risks for infrastructure projects and the impact of tax reforms on such developments.
