Brazil approves new AI regulations for the education sector
The National Council of Education (CNE), an entity linked to the Ministry of Education, has approved new guidelines to regulate the use of artificial intelligence in Brazilian education. These rules apply to all levels and modalities of teaching in both public and private systems.
A key provision prohibits the use of AI for grading exams, essays, and discursive assessments. The guidelines mandate that decisions regarding grades, student approval, failure, or disciplinary actions must involve significant human analysis and validation. AI is intended to serve only as a complementary tool and must not replace educators.
The regulations also restrict AI use for children up to 10 years old (typically up to the 5th grade of elementary school), prohibiting autonomous use without educator supervision. Additionally, the guidelines ban emotion recognition systems for students or teachers, continuous biometric surveillance, and fully automated decisions that could impact a student's academic trajectory.
