Overview
The legal profession and academic institutions continue to navigate the dual challenges of artificial intelligence integration and institutional regulation. In education, the rise of generative AI tools is prompting a re-evaluation of learning processes. At the 4th Meeting of 21st Century Educators in Rio de Janeiro, UNESCO consultant Daniela Costa emphasized that digital inclusion must be ‘significant and critical,’ focusing on teaching students to use tools with purpose and an awareness of risks. This approach aims to prevent students from using technology at the expense of actual learning. In Peru, data from CADE Educação 2026 highlighted a gap in implementation: while AI adoption is high, only 8% of teachers have integrated these tools into their core teaching methodologies, occurring alongside concerns regarding declining reading comprehension and mathematical reasoning. Within the judiciary, efforts are expanding toward addressing digital transformation and cybersecurity. In Brazil, the 17th Annual Meeting of the Association of Lawyers of São Paulo (AASP) is addressing the limits of AI, data protection, and the preservation of digital evidence. Similarly, the Court of Justice of the State of Bahia (TJBA) is organizing training to mitigate risks like ‘Prompt Injection.’ In the United States, the 3rd ExpoJud USA in Florida is exploring the integration of generative AI to automate repetitive tasks, the use of blockchain and Big Data, and the necessity of updating judicial school curricula to include digital law and data analysis. Newer developments in Spain show judicial bodies addressing the specific risks of generative AI in legal filings. The Civil and Criminal Chamber of the High Court of Justice of Andalusia (TSJ) cautioned that while AI tools are not prohibited in appeal resources, AI-generated documents must not substitute for the ‘substantive argumentative density’ required by constitutional and procedural law.
