Brazil Chamber passes indigenous LGBTIA+ rights protection bill

The Chamber of Deputies' Culture Committee approved Bill 5943/25, which adds explicit protections for indigenous LGBTIA+ people to the Indigenous Statute (Law 6.001/73). Sponsored by Deputy Duda Salabert (PSOL‑MG) and reported by Deputy Célia Xakriabá (PSOL‑MG), the proposal seeks to prevent discrimination, violence, and territorial expulsion based on sexual orientation or gender identity.

The law guarantees full civil, political, social, economic and cultural rights for indigenous individuals regardless of gender identity or sexual orientation. It mandates that health services collect gender and sexuality data confidentially, expands mental‑health and suicide‑prevention programs, and ensures access to comprehensive sexual and gender‑affirming care. In education, indigenous schools must incorporate human‑rights and gender‑diversity content and adopt anti‑bullying measures.

Cultural provisions call for public support of art and memory projects that reflect indigenous sexual and gender diversity. An emergency protection mechanism will provide safe shelter, psychosocial assistance, and territorial guarantees for those threatened or expelled. The bill also creates the annual “Tybyra Day” on May 19, commemorating the 17th‑century indigenous individual executed for homosexuality, and requires public agencies to include sexual orientation and gender identity data in indigenous statistics.
