Brazil considers law to annul fines from hidden speed radars

A new legislative proposal, Bill 2364/26, is currently under analysis in the Brazilian Chamber of Deputies. The bill aims to amend the Brazilian Traffic Code to increase transparency in electronic speed enforcement.

If approved, the legislation would mandate that speed radars and measurement devices be installed in locations clearly visible to drivers. The proposal stipulates that traffic fines issued by equipment that is hidden, camouflaged, or lacks prior signage would be automatically annulled.

Authored by Deputy André Fernandes, the bill argues that electronic enforcement should serve an educational rather than a purely punitive purpose. Until the bill passes through both the Chamber and the Senate, current regulations established by CONTRAN Resolution 798/2020 remain in effect, requiring technical surveys and specific signage for speed enforcement.
