Brazil advances tax reform with new invoice rules and devedor contumaz legislation
The federal government has adjusted the rollout of Brazil's tax reform by redefining the calendar for electronic fiscal documents. The Joint Act RFB/CGIBS No. 4/2026 keeps the mandatory start date for NF‑e, NFC‑e, CT‑e, CT‑e OS and MDF‑e on 3 August 2026, while NF‑Se, NFCom and DeRE events become compulsory on 1 October 2026 and more complex‑sector documents on 1 December 2026. A technical act (RFB/CGIBS No. 1/2026) temporarily suspends the automatic rejection of invoices that lack the new CBS and IBS fields, giving companies extra time to adapt.
A decree (13.075) postpones to 1 January 2027 the requirement for individuals to register in the CNPJ to issue fiscal documents, easing the burden on small producers and nano‑entrepreneurs. Meanwhile, the Programa Nos Conformes has recovered R$ 16.3 billion up to March 2026, reflecting the effectiveness of voluntary compliance measures.
The Rio de Janeiro state government has forwarded a "Devedor Contumaz" bill that would penalise firms with debts of at least R$ 15 million and assets below that amount, barring them from tax benefits, public contracts and, in cases of fraud, cancelling their state registration. In João Pessoa, the municipal treasury extended the ISS payment deadline for July 2026 services to 14 August 2026 because of system instability. Belém’s mayor has proposed a law to forgive ISS debts accumulated by mototaxistas up to 2026, cancelling interest and penalties. The National Council of Justice issued guidance allowing courts to extinguish old tax execution cases through prescription intercorrente.
